  • improve our services and understand how people use our website.

We will not use information collected through the website for purposes that are incompatible with the reason it was originally supplied.

7. Our lawful bases

Data protection law requires us to have a lawful reason for using personal information. Depending on the circumstances, we may rely on:

Taking steps before entering into a contract

We may use your information to respond to an enquiry, arrange a visit, discuss availability or take steps towards offering your child a place.

Performance of a contract

Where your child attends the nursery, we use relevant information to provide childcare and early education services under our agreement with you.

Legal obligation

We may use information where necessary to comply with childcare, early years, safeguarding, employment, tax, funding, health and safety or other legal requirements.

Legitimate interests

We may use information where it is reasonably necessary for the proper operation of the nursery, provided that our interests do not override your rights. This may include:

  • responding to and keeping records of enquiries;
  • managing waiting lists;
  • following up a genuine nursery enquiry;
  • maintaining website security;
  • preventing fraud or misuse;
  • improving our website and services;
  • managing complaints or legal claims;
  • providing relevant information about our own nursery services, where lawful.

Consent

We may rely on consent where you have a genuine choice, for example for:

  • certain photographs;
  • optional marketing communications;
  • non-essential cookies, should these ever be introduced.

You may withdraw consent at any time.

Vital interests

In an emergency, we may use or share information where it is necessary to protect someone’s life or physical safety.

8. Marketing communications

We may occasionally contact parents, carers or people who have made an enquiry with relevant information about our own nursery services.

This may include information about:

  • nursery places and availability;
  • King’s Castle or King’s Lodge;
  • open days and visits;
  • funded childcare;
  • services that are closely related to the original enquiry.

We will not pass your details to another business so that it can market its services to you.

Where consent is required for marketing by email, text or another electronic method, we will seek that consent. Where the law permits us to rely on another lawful basis, we will still respect your reasonable expectations and privacy rights.

Every electronic marketing message will provide a clear way to unsubscribe or opt out.  You can also ask us to stop marketing communications at any time by contacting:

Email: info@kingscastlenursery.co.uk
Telephone: 01202 422235

Opting out of marketing will not stop important administrative, contractual, safeguarding or service-related communications.

9. Health, SEND and other sensitive information

Information about health, disabilities, SEND, ethnicity, religion or similar matters may be classed as special category personal data and receives additional legal protection.

We will only collect or use this information where it is necessary and where both a lawful basis and an additional legal condition apply. This may include:

  • providing appropriate care and support;
  • meeting our legal duties;
  • protecting a child’s health, welfare or safety;
  • safeguarding children or other individuals;
  • establishing, exercising or defending legal claims;
  • acting with explicit consent where that is appropriate.

We only ask for sensitive information that is relevant and necessary.

We will not use information about a child’s health, SEND or other sensitive circumstances for marketing purposes.

10. Children’s information

Children’s personal information requires particular care and protection.

Initial website enquiries should normally be made by a parent or person with parental responsibility. We ask parents and carers not to provide more information about their child than is reasonably necessary at the enquiry stage.

Once a child is registered with or attends the nursery, additional information will be collected and used in accordance with our nursery Data Protection, Privacy and Confidentiality Policy and other relevant policies.

The welfare and best interests of the child will be an important consideration whenever we use or share a child’s information.

We do not sell children’s information, use it for advertising or provide it to unrelated organisations for marketing.

11. Famly enquiries

Our website provides a link to the Famly childcare-management platform so that parents and carers can submit an enquiry.

When you follow the link to Famly:

  • you will leave the King’s Castle website;
  • Famly may collect information through its own website or platform;
  • Famly’s privacy and cookie information will apply to your use of its service;
  • information submitted for a King’s Castle enquiry will be made available to us so that we can respond.

You should read the privacy information displayed by Famly before submitting your details.

We use information received through Famly only for appropriate nursery enquiry, registration, administration, communication, safeguarding and childcare purposes, and for relevant marketing about our own nursery services where lawful.

We do not permit Famly to sell enquiry information on our behalf or use it for unrelated third-party marketing.

12. Who we may share information with

We do not share personal information with third parties for their own advertising or marketing.

Where necessary and lawful, we may share limited information with:

  • Famly and other providers that support our nursery-management systems;
  • website hosting, maintenance and IT-support providers;
  • professional advisers, including accountants, insurers, solicitors and consultants;
  • payment, funding or administrative service providers;
  • local authorities and government departments;
  • Ofsted and other regulators;
  • schools, health professionals or other agencies supporting a child;
  • safeguarding partners, social care services or the police;
  • courts, tribunals or law-enforcement bodies;
  • prospective purchasers or advisers in connection with a genuine business sale or restructuring, subject to appropriate safeguards.

This sharing is for operational, professional, legal, regulatory, contractual or safeguarding reasons. It is not the sale of personal information.

We only share information where there is a proper reason to do so, and we expect organisations processing information on our behalf to keep it secure and use it only for the agreed purpose.

We may share information without consent where this is necessary to protect a child or another person, meet a legal obligation, investigate a crime or respond to a safeguarding concern.

13. International transfers

Some website, email, cloud-storage or software providers may store or access information outside the United Kingdom.

Where personal information is transferred internationally, we will take reasonable steps to ensure that an appropriate legal safeguard is in place, such as:

  • a UK adequacy decision;
  • approved contractual safeguards; or
  • another lawful transfer mechanism.

14. How long we retain information

We keep personal information only for as long as it is reasonably needed for the purpose for which it was collected and to meet any legal, safeguarding, insurance or regulatory requirements.

As a general guide:

  • routine enquiries that do not lead to a nursery place will normally be retained for up to 12 months after the last meaningful contact;
  • waiting-list and registration information may be retained while an application remains active;
  • information relating to a child who joins the nursery will be retained in accordance with our nursery records-retention arrangements;
  • unsuccessful job applications will normally be retained for up to 12 months, unless the applicant agrees to a longer period;
  • website security and technical logs will normally be retained only for the period reasonably required for security, troubleshooting and system administration;
  • information relating to complaints, safeguarding matters, accidents or legal claims may need to be retained for longer;
  • where a person has opted out of marketing, we may retain limited information on a suppression list so that we can respect that preference.

Information will be deleted or securely destroyed when it is no longer required.

15. Cookies

Cookies are small files placed on a device when a website is visited.

Our intention is to use only cookies that are strictly necessary for the website to operate securely and correctly.

Strictly necessary cookies may be used for purposes such as:

  • website security;
  • remembering essential settings;
  • operating forms;
  • preventing misuse;
  • maintaining the website’s basic functionality.

We do not intend to use:

  • advertising cookies;
  • behavioural-profiling cookies;
  • remarketing cookies;
  • cookies that track visitors across unrelated websites;
  • other non-essential cookies without the required consent.

If non-essential analytics, embedded content or third-party tools are introduced in the future, we will review whether consent is required and, where necessary, provide an appropriate cookie banner and preference controls before those cookies are placed.

Third-party websites, including Famly and social-media platforms, may use their own cookies when you follow a link from our website. Their own privacy and cookie notices will apply.

Further details will be provided in our separate Cookie Policy following a technical cookie scan of the website.

16. Links to other websites

Our website may contain links to Famly, social-media pages, Montessori organisations or other external websites.

We are not responsible for the privacy practices, security or content of external websites. You should read the privacy information provided by the relevant organisation before supplying personal information.

Following an external link does not give us permission to sell or share your personal information with that organisation.

17. Website security

We take reasonable technical and organisational measures to protect personal information against:

  • unauthorised access;
  • accidental loss;
  • misuse;
  • alteration;
  • disclosure; and
  • destruction.

However, transmitting information over the internet cannot be guaranteed to be completely secure. Please avoid sending highly sensitive information through ordinary email unless it is necessary.

18. Your data-protection rights
